Terms of Service

The short version: Use Mind Like Water reasonably. You own your content. We bill you what the pricing page says. You can cancel anytime. We try hard to keep the service running but can't promise perfection.

1. The agreement

These terms form a binding agreement between you and Titus Digital LLC ("we", "us", "our"), the operator of Mind Like Water ("the Service"). By signing up for or using the Service, you agree to these terms. If you don't agree, don't use the Service.

2. What the Service is

Mind Like Water is a productivity application based on the Getting Things Done (GTD) method. It helps you capture tasks, manage projects, take notes, and organize your work across Areas of Focus. Features evolve over time — we reserve the right to add, change, or remove features, and we'll give reasonable notice of material removals.

Pricing and tiers

Mind Like Water offers a free tier with usage limits and a paid "Pro" tier. Current pricing and limits are listed at mindlikewater.app/pricing. Prices may change — existing subscribers will be notified of any price increase at least 30 days before it takes effect on their subscription.

Free trial

New accounts start with a 14-day free trial of the Pro tier. No credit card is required to start the trial. At the end of the trial, your account reverts to the free tier unless you have subscribed.

Billing

Founding member pricing

The first 100 paying subscribers may subscribe at the founding price of $5/month. This price is locked for as long as your subscription remains continuously active. If you cancel and later re-subscribe, you'll be subject to the then-current standard pricing — the founding price cannot be reclaimed after cancellation.

Refunds

Subscription fees are generally non-refundable, and we don't issue automatic refunds for partial billing periods. If something unusual happens — a bug caused you to be charged unexpectedly, a failed service outage, or similar — email [email protected] and we'll handle it in good faith.

5. Your content

You own the content you create in Mind Like Water. We don't claim ownership over your tasks, notes, projects, or any other content you produce. By using the Service, you grant us a limited license to host, store, transmit, and display your content solely for the purpose of operating the Service for you.

We don't use your content to train AI models. We don't sell it. We don't share it with third parties other than the infrastructure providers listed in our Privacy Policy, all of whom are bound to handle it securely.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

7. Service availability

We work hard to keep Mind Like Water running reliably, but we don't promise 100% uptime. The Service may be unavailable for maintenance, upgrades, or reasons beyond our control (infrastructure provider outages, force majeure, etc.). We aim to give notice of planned downtime when practical.

8. Our intellectual property

The Mind Like Water software, design, brand, and associated trademarks are our property. These terms don't grant you any rights to our trademarks or to our software beyond what's necessary to use the Service as intended.

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the Service will be error-free, uninterrupted, or meet any specific requirements.

Mind Like Water is a productivity tool, not a system of record for legally significant information. Don't rely on it alone for anything mission-critical — keep your own backups of important data via the export feature.

11. Limitation of liability

To the maximum extent permitted by law, in no event shall Titus Digital LLC or Mind Like Water be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of your use of the Service. Our total aggregate liability for any claim related to the Service is limited to the amount you've paid us in the 12 months preceding the claim.

12. Governing law

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles. Any dispute arising from these terms will be resolved in the state or federal courts located in King County, Washington.

13. Changes to these terms

We may update these terms from time to time. Material changes will be announced via email to registered users at least 14 days before taking effect. Continued use of the Service after a change takes effect means you accept the updated terms. The "Last updated" date at the top of this page always reflects the current version.
